This agreement is between Fullturn Web Solutions, a Georgia limited liability company (“Fullturn Web Solutions”), and its client, (“Client” or “you”) and shall apply to all services ordered by Customer and provided by Fullturn Web Solutions(collectively, the “Services”).
You as a “client” gives “Fullturn Web Solutions” permission to access your website and hosting account. We keep records of every username and password provided to us for the client’s convince of multiple projects.
1.) “Fullturn Web Solutions” owns the copyright right to any work done until the client has paid us in full payment.
2.) You as the “client” guarantee that any element such text, graphics, photos, designs, trademarks, or other artwork provided to “Fullturn Web Solutions” for use in the design are owned by you as the “client”, or that you as the “client” has permission from the rightful owner to use each of these elements. You also agree to hold “Fullturn Web Solutions” harmless and to protect and defend “Fullturn Web Solutions” from a lawsuit or claim of infringement arising from the use of these elements.
1.) You as the “client” agree to give us 24 hours to respond to your email or phone call. We receive tons of emails and phone calls every day. If you have sent an email and 24 hours have passed and you have not heard back from us then please call us at (678) 667-3411
2.) You as the “client” understand that if we “Fullturn Web Solutions” request a file or information from you that you have exactly 24-48 hours “unless noted on your project” to provide us “Fullturn Web Solutions” with the requested information. If we “Fullturn Web Solutions” do not hear back from you within in the time frame we “Fullturn Web Solutions” give then we “Fullturn Web Solutions” will have to place your project “On Hold” and you will have to reschedule with us “Fullturn Web Solutions” to start again and other fees may apply.
3.) Due to unforeseen circumstances like weather, cable outage or sickness we “Fullturn Web Solutions” ask that you be patient as we fix these issues if they arise. If we “Fullturn Web Solutions” have an outage due to connection or weather we will post an announcement using twitter via our Tablet. Please refer to https://www.twitter.com/fullturnweb for all updates concerning emergency outages, weather or unexpected sickness. This is of course a rare event, but in case of an emergency, we would like to have the best way possible to inform our clients.
“Fullturn Web Solutions” agrees to make minor changes or fix issues for the “client’s” project for up to 30 days after completion. Anything other than this will be subject to a fee or an hourly rate, “Fullturn Web Solutions” will quote the “client” on how long changes will take and cost and guarantee not to go above the rate agreed upon by “Fullturn Web Solutions” and the “client”. Maintenance payments are to be paid in full before work has begun.
You as the “client” agree that you are solely responsible for complying with such laws, taxes, and tariffs, and will hold harmless, protect, and defend “Fullturn Web Solutions” from any claim, lawsuit, penalty, tax, or tariff arising from the “client’s” exercise of Internet electronic commerce.
6. Payments, Cancellations and Refunds
1.) You agree to make payments based upon the payment schedule as listed on your proposal (page 1), The Deposit Payment is due before any work will be started. The Final Payment is due in full before any project files are released to you and before we install, take your website live (unless noted otherwise in your proposal.
2.) We accept Visa, Mastercard, AMEX, Discover We also accept Checks for the convince of our clients. If payment is made with a check please note that work will not being till check has cleared our bank. Checks can take up to 5-6 days to clear our bank.
3.) Please note due to the nature of our work we do NOT issue refunds. The “client” and “Fullturn Web Solutions” reserve the right to cancel a project at anytime, any deposits paid will not be refunded and if work hours exceed the initial deposit fee we will require payment for the time used and will bill you accordingly. “Fullturn Web Solutions” will make every reasonable effort to satisfy our client, but work commissioned must be compensated for.
6.1 Late Fees
Payments not received within ten (10) days of invoice or due date will be considered late and will incur and accrue interest from the due date at the rate of one and one-half percent (1.5%) per every ten (10) days or the maximum legal rate, whichever is lower.
7. Web Hosting
Client understands that they must provide their own web hosting account to host their website.
7.1 Domain Name
Client understands that they must purchase their own domain name.
During website development, “Fullturn Web Solutions” shall provide the Client with changes to the design concept at no additional charge. Alternatively, the Client may choose to reject the first design concept before any revisions are requested and receive an additional design concept with three rounds of changes to the second design concept at no additional charge.
Any additional design changes shall be governed by a separate “Change Order” which will describe the exact nature of the changes requested and any additional fees. The Client shall have three (3) business days from receipt of the” Change Order” to accept the terms and conditions of the “Change Order”, otherwise the “Change Order” shall be deemed rejected.
No “Change Order” shall be binding upon either party unless signed by both parties. Upon execution by both parties, a signed Change Order shall amend the original “Service Agreement” and become a part thereof. Notwithstanding the foregoing, “Fullturn Web Solutions” shall have the right to refuse a “Change Order” for any reason in its sole and absolute discretion.
